Policies

Everyday Drivers or Carzi (herein called “Company” or “Owner”) rents to the Renter signing this Agreement the Vehicle described. Renter agrees that rental is subject to the terms set forth on both sides of this Agreement.

Pickup Policy: Reservations scheduled for pickup between 10:00pm and 6:00am the following day must have pre-trip checkin completed by 7:00pm prior to trip start time, otherwise we cannot guarantee pickup for your selected time. Your vehicle pickup time will be rescheduled to 7:00am the following morning.

Extensions: Extensions must be requested prior to the end of your trip and must be done via the carzi chat line at 480-389-4572. Extensions are not guaranteed and require approval and a revised rental agreement. Extension rates will be provided to you at the time of request and are subject to change. Vehicles not returned prior to their scheduled return times are subject to 2x the current daily rental rate for vehicle classification and will be charged to the card the card on file.

Renter has inspected the Vehicle and acknowledges that it is in good condition. Renter will return Vehicle in same condition, with all tires, accessories and equipment to the location and on the due-back date specified or sooner upon demand by COMPANY.

TERMS AND CONDITIONS
The rental vehicle may be operated only by the renter and authorized additional driver, operation by anyone else will violate this contract and any options chosen. Everyday Drivers LLC or carzi has waived uninsured/underinsured motorist coverage and does not provide operator or passengers with the same. I acknowledge that by providing Everyday Drivers LLC my payment method, I am agreeing to any charges deemed necessary based on the terms and conditions set forth and give Everyday Dfivers LLC Of carzi permission to use this method of payment for this transaction
OTHER TERMS AND CONDITIONS
1.Minimum rental charge 24 hours plus mileage
2.I understand I'm responsible for payment of all tolls, fines and violations hereby authorized Everyday Drivers LLC or carzi to release my rental information and charge my debitlcredi1 card information to citation & violation Management for the exclusive purposes of processing, billing, and/or payment for tolls, parking, or traffic: fines, fees, penalties, and/or an administration fee up to $125 for each infraction or toll incurred during rental
3.Vehicles are allowed only in the Phoenix metropolitan areas unless stated below in other areas. Out of state travel may be subject toa $250 fine
4.Everyday Drivers LLC or carzi shall not be responsible foray property left behind in vehicle.
5.There will be a $250 charge for lost keys
6.All repairs must be approved by Everyday Drivers LLC or carzi. Renter is responsible r all repair costs, towing, and other charges that vehicles outside the designated area as specified
7.Early return fee: up to $49 (no refund for early returns)
8.Late return fee: no charge up to 30 minutes and 2x the current 1-day daily rental rate for your vehicle classification up to 12 hours. After 12 hours the vehicle is considered not returned and a $500 non-refundable charge will be billed to the card on file used for deposit.
9.Per A.R.S.13-1806, your rental vehicle will be reported stolen after 72 hours past the due date and time and the penalty is a class 5 felony.
10. A cleaning fee of up to $250 may be charged for returned vehicles which have been stained, soiled or found with significant amounts of filth/dirt/mud/animal hair or other substances.
11. A vehicle which is picked up and removed from the lot is deemed acceptable by the renter and not eligible for any refund. Should you find your vehicle unacceptable it is your responsibility to report this to our chat line at 480-389-4572 so we may find a more suitable option for you.
12. Smoking/vaping is prohibited. A fee of up to $250 may be charged for vehicles returned with ash, evidence of tobacco, marijuana, any any other substance which has been smoked and any identifiable smell of cigarettes, marijuana or substance smoked.

Except Renter, any additional driver shown on the reverse side or with Renter’s prior consent, a qualified licensed driver of at least 21 years of age who is either a member of Renter’s immediate family, Renter’s employer or Renter’s employee;
-or who has given COMPANY any false or misleading information, including name, age, address, place of employment or the true identity of any person who will use the Vehicle;
-or who has any measurable amount of alcohol or any drugs (prescribed or otherwise) in his/her system at the time,
-or is under the influence of any other substance which tends to impair driving ability; or for the transportation of person or property for hire;
-or in any race, speed test or contest,
-or for any illegal purpose;
-or To propel, push or tow any vehicle or any illegal purpose;
-or when the odometer has been tampered with or disconnected;
-or Out of the State of Arizona,
-or For off-roading purposes Towing purposes
In violation of any Federal, State or Municipal law, ordinance, rule or regulation governing the use, operation or return thereof.

The above restriction shall apply to each and every use of the Vehicle. A violation of any restriction shall render this Agreement, including the exceptions of paragraph 5, voidable by COMPANY to the extent permitted by law.

COMPANY may retake possession of Vehicle at any time and any place without demand first being made, at Renter’s cost if it is illegally parked, used in violation of law, contrary to the terms of this Agreement, is apparently abandoned or is not returned as herein agreed.
Renter will pay Company for all charges for time and mileage as determined by the Vehicle’s odometer, Collision Damage Waiver (CDW),
Personal Accident Insurance (PAI), State and local sales and use taxes, drop charge and any other charge entered on the re- verse side. If Renter has requested the billing for said charges to be made to another per- son or company, and upon billing they should fail to make payment, Renter upon demand or Company, shall promptly pay the charges.

Renter shall pay and by solely responsible for all fines, penalties, forfeitures, costs, expenses and attorney’s fees incurred by Company as a result of parking or traffic violations issues before Vehicle is returned to Company as herein provided in addition to a service charge for processing by Company. Renter shall also pay all costs of returning Vehicle to renting office in the case of an accident or in any case if Vehicle was taken out of Arizona without prior written consent.

RENTER IS RESPONSIBLE FOR ALL LOSS OR DAMAGE TO VEHICLE, INCLUD- ING LOSS OF USE, WHETHER OR NOT CAUSED BY THE NEGLIGENCE OR OTHER FAULT OF RENTER OR ANY OTHER PERSON.

Except as provided in subparagraph (b), Renter’s liability is:
Limited to the deductible amount shown on the separate Agreement entitled “Collision Damage Decline,” or
Waived by Company provided Renter accepts Collision Damage Waiver on the reverse side and pays the additional charge. COLLISION DAMAGE WAIVER IS NOT INSURANCE BUT IS A WAIVER OF Company’s right to recover from Renter for damages to the Vehicle while in Renter’s possession.

Any limitations on, or waiver of, Renter’s Liability for loss or damage contained in Subparagraph (a) does not apply to any loss or damage.
WHICH OCCURS IF VEHICLE IS USED IN VIOLATION OF THIS AGREE-
MENT, INCLUDING PARAGRAPH 2, or
DUE TO THE THEFT OF VEHICLE REGARDLESS OF ANY COLLISION DAMAGE WAIVER COVERAGE EXTENDED.
CAUSED BY SNOW CHAINS, PETS OR ANIMALS, OR ANY DAMAGE INTENTIONALLY INFLICTED; or
CAUSED BY ANY ACT OR MISSION OF ANY DRIVER OF THE VEHICLE HELD TO BE WILLFUL OR GROSSLY NEGLIGENT OR WHICH RESULTS IN CONVICTION OF RECKLESS DRIVING.
IF DAMAGE OCCURS PURPOSELY, VOLUNTARILY OR DUE TO NEGLIGENCE
THE THEFT AND VANDALISM OF ALL PARTS, ACCESSORIES, ENGINE DAMAGE, TRANSMISSION, UNDER CARRIAGE DAMAGE AND ANY AND ALL ABUSE CAUSED TO THE VEHICLE REGARDLESS OF ANY COLLISION DAMAGE WAIVER COVERAGE EXTENDED.
MISSING GAS CAPS, SPARE TIRES, IRONS, JACKS, HUB CAPS, ACCESSORIES, WINDOWS AND WINDSHIELD DAMAGE OR ANY OTHER TOOLS OR ITEMS ARE NOT COVERED BY CDW AND IS RENTER’S RESPONSIBILITY.

THIS AGREEMENT DOES NOT PROVIDE RENTER WITH INSURANCE COVER- AGE. Renter is solely responsible for complying with the financial responsibility laws of this State.
Owner does not provide insurance coverage. Renter accepts sole responsibility for any and all costs, obligations, expenses, lawsuits and liabilities (including attorney’s fees) arising from use of the rented vehicle, for any and all users of the vehicle while it is subject to this rental agreement.

Renter expressly represents that (s)he has liability insurance that covers his/her operation of the rented vehicle, and/or that (s)he otherwise meets and satisfies, and will continue to meet and satisfy state financial responsibility laws pertaining to the operation of a motor vehicle.
Renter expressly agrees to indemnify and hold Owner, its subsidiaries, agents and employees, harmless from any and all liability or claim arising from the operation of the rented vehicle in the event that their insurance coverage/financial responsibility for any reason
fails to cover and to protect Owner from liability or claim arising from Renter’s operation of the rented vehicle.

Nothing herein shall be construed to be a waiver of Company’s right of subrogation under Title 28 of the Arizona Vehicle Code or of the Company’s right of indemnity upon a finding or comparative fault.

Renter releases and holds Company, it’s agent and employees harmless (1) from all claims from the loss or damage to any property of Renter or any other person left in, on or about the Vehicle, either before or after it’s return to Company, or on Company’s premises, without regard to any negligence of Company or any of it’s agents or employees, Renter shall defend, indemnify and hold Company harmless from and against any and all losses, liabilities, damages, injuries, claims, demands, costs, attorney’s fees and expenses arising out of the use or possession of the Vehicle including, but not limited to, any and all fines, penalties and forfeitures imposed under any Federal, State, Provincial, Municipal or other stature, law, ordinance, rule or regulation, or (2) to the extent not covered by any insurance, any claims of, or liabilities to, third persons arising out of the abandonment, conversion, recreation, concealment or unauthorized sale of the Vehicle by Renter, or his drivers, agents or employees, or the confiscation of the Vehicle by any governmental authority for illegal or improper use of the Vehicle.

Renter admits actual knowledge that any person who has leased or rented a Vehicle and willfully and intentionally fails to return the Vehicle to it’s owner within (5) days after the lease or rental agreement has expired shall be presumed to have embezzled the Vehicle. Company reserves the right to accelerate the expiration date of this Agreement upon any breach thereof, including Paragraph 2. Notice of such acceleration may, at the discretion of Company, be given personally or by mail or telegram addressed to Renter as shown on reverse side. Notice shall be deemed received by Renter immediately upon notice given verbally in person, 24 hours after the transmission of a telegram or 48 hours after it’s mailing.

(A) RENTER RELEASES AND DISCHARGES COMPANY AND AGREES TO DEFEND AND HOLD COMPANY HARMLESS FROM AND AGAINST ALL COSTS, EXPENS- ES (INCLUDING ATTORNEY’S FEES), CLAIMS, SUITS OR DEMANDS OF ANY KIND RELATING TO ANY ALLEGED CLAIM OF FALSE ARREST, FIALSE IMPRISONMENT, DEFAMATION, ASSAULT, MALICIOUS PROSECUTION, TRESPASS, INVASION OF PRIVACY OR CIVIL RIGHTS, OR ANY OTHER CAUSE RELATING TO, OR ARISING FROM ANY REPORT BY COMPANY OR ITS, AGENTS AND EMPLOYEES TO ANY LAW ENFORCEMENT AGENCY THAT THE VEHICLE HAS NOT BEEN RETURNED TO COMPANY AFTER THE EXPIRATION OF THIS AGREEMENT. RENTER, LIKEWISE RELEASES AND DISCHARGES COMPANY AND AGREES TO DEFEND AND HOLD COMPANY HARMLESS FROM AND AGAINST ALL SUCH COSTS AND EXPENSES RELATING TO ANY SUCH ALLEGED CLAIMS RELATING TO, OR ARISING FROM, ANY SELF-HELP OF VEHICLE UPON A FINDING THAT COMPANY HAS KNOWLEDGE OF FACTS WHICH WOULD CREATE A REASONABLE BELIEF THAT THE RENTER WAS WILLFULLY OR INTENTIONALLY FAILING TO RETURN THE VEHICLE AFTER THE EXPIRATION OF THIS AGREEMENT.

(B) COMPANY SHALL NOT WITHSTANDING ITS NEGLIGENCE OR OTHER FAULT- OR THE NEGLIGENCE OR OTHER FAULT OF ITS AGENTS OR EMPLOYEES, NOT BE LIABLE FOR LOSS OR DAMAGE TO ANY PROPERTY LEFT, STORED OR TRANSPORTED IN OR UPON THE VEHICLE OR ANY SERVICE OR RENTAL VEHICLE OF COMPANY. EITHER BEFORE OR AFTER ITS RETURN TO COMPANY, OR FOR LOSS OR DAMAGE TO PROPERTY LEFT OR STORED UPON ANY PREMISES OF COMPANY. RENTER AS- SUMES ALL RISK OF SUCH LOSS OR DAMAGE AND WAIVES ALL CLAIMS AGAINST COMPANY THEREFOR.

The number of miles which Vehicle shall have been operated while in Renter’s possession shall be recorded by the standard odometer installed in the Vehicle by the manufacturer. In the event said odometer is disconnected or tampered with while rented to Renter, the parties agree that actual mileage would be difficult, if not impossible to ascertain and agree in such event that renal charges shall be based on 800 miles per day, which they agree is a reasonable estimate of actual mileage driven.

This Agreement is a contact which was in fact entered into in the County and judicial district wherein Company’s rental office is located. In the event it becomes necessary for Company to commence litigation to enforce the terms of this Agreement, to recover money for unpaid charges or physical damage to Vehicle, or for subrogation under Title 28 of the Vehicle Code, Company shall be entitled to recover it’s reasonable attorney’s fees incurred thereby. Unpaid charges shall bear interest from the date incurred at the maximum rate permitted by law effective on the date of this Agreement. Sums due for physical damage or for subrogation shall bear such maximum interest allowed by law from the date of the occurrence giving rise to such payment.

IF ALL CHARGES IMPOSED HEREUNDER ARE NOT PROMPTLY PAID THE RENTER SHALL PAY TO COMPANY AN ADDITIONAL CHARGE OF 1 ½% PER MONTH, 18% PER YEAR ON THE UNPAID BALANCE, INCLUDING INTEREST AND SERVICE FEE. THE RENTER SHALL ALSO PAY TO COMPANY ALL REPOSSESSION COSTS, COURT COSTS, COLLECTION FEES INCURRED TO EFFECT COLLECTION OF RE- POSSESSION.

I AGREE THAT AL CHARGES, FEES AND EXPENSES, INCLUDING PAYMENT FOR LOSS OF OR DAMAGE TO THE VEHICLE ARE DUE AT YOUR REQUEST. I WILL PAY ANY COLLECTION COSTS, INCLUDING YOUR REASONABLE ATTORNEY’S FEES, IF I DO NOT PAY NAY AMOUNT WHEN DUE. IF THE LAW PERMITS, YOU MAY CON- TACT ME OR MY EMPLOYER AT MY PLACE OF BUSINESS IN CONNECTION WITH YOUR COLLECTIONS. IF A THIRD PARTY HAS BEEN DESIGNATED TO PAY AND BILL AND THAT PARTY DOES NOT PAY PROMPTLY AFTER BILLING. I SHALL BE FULLY RESPONSIBLE FOR PROMPTLY PAYING MY BILL. I AGREE THAT ANY UNPAID BALANCE IS SUBJECT TO INTEREST AT AN ANNUAL RATE OF 18% COMPUTED ON A MONTHLY BASIS OR THE MAXIMUM RATE PERMITTED BY APPLICABLE LAW, WHICHEVER IS GREATER.

I AGREE TO EVERYTHING STATED ON BOTH SIDES OF THIS AGREEMENT, WHICH IS THE ENTIRE AGREEMENT BETWEEN MYSELF AND GREEN MOTION. I UNDERSTAND THAT THIS AGREEMENT CAN ONLY BE CHANGED IN WRITING, SIGNED OR INITIALED BY EVERYDAY DRIVERS LLC OR CARZI
